Terms and Conditions

1. Introduction

These Terms & Conditions (“Terms”) govern your use of pandb.lk. By accessing or using our platform, you agree to follow these Terms. If you do not agree, please discontinue use of the site.

2. Eligibility

To use our platform:

• You must be 18 years or older, or
• You must have parental or guardian approval (as required by Sri Lankan law)
• You must provide accurate information during registration

3. Account Responsibilities

By creating an account:

• You are responsible for keeping your login details secure
• You agree that all activities under your account are your responsibility
• You must notify us immediately if your account is compromised

We may suspend or terminate accounts that violate our rules

4. Auction Rules

4.1 Bidding

• All bids are final, binding, and cannot be withdrawn
• You agree to pay the full amount if you win
• Artificial or fraudulent bidding is strictly prohibited

4.2 Winning an Auction

The highest valid bid at the end of the auction wins. Payment must be completed within [time frame, e.g., 48 hours]. Failure to pay may result in cancellation or account suspension.

5. Listing Items

If sellers can list their own items, include:

• Sellers must provide accurate and honest item descriptions
• Sellers must have legal ownership of the item
• Listing illegal, harmful, or prohibited items is not allowed

6. Payments

• All payments are processed through CyberSource
• We do not store your card or bank details
• Payment errors caused by third-party services are beyond our control

6.1 Credit Card Processing Fee (Seller-Borne)

If a buyer completes the final payment using a credit card, the payment gateway may apply an additional 3% processing fee to the transaction amount. While this fee may be charged at checkout as part of the credit card payment process, the seller agrees to bear (absorb) this cost. Accordingly, the equivalent 3% fee will be deducted from the seller’s payout/settlement amount for that transaction. The applicable fee percentage is determined by the payment service provider and may change from time to time.

7. Shipping & Delivery

• Shipping terms depend on the seller or platform’s policy
• Estimated delivery times are approximate
• Delays caused by courier services are not our responsibility

8. Returns & Refunds

This is a temporary placeholder until your client provides final rules:

• Refunds may be considered only for incorrect or misrepresented items
• Auction wins cannot be canceled after payment
• Some items may not be eligible for return (e.g., digital products)

9. Prohibited Activities

Users must NOT:

• Use false information
• Manipulate auction results
• Post harmful, offensive, or illegal content
• Attempt to hack, damage, or disrupt the platform
• Violate Sri Lankan laws

10. Disclaimer

We provide the platform “as is” and do not guarantee:

• 24/7 uptime
• Error-free operation
• Accuracy of third-party content (including seller listings)

11. Limitation of Liability

To the fullest extent allowed by Sri Lankan law, we are not responsible for:

• Lost profits or business
• Damage caused by service interruptions
• Issues between buyers and sellers

12. Changes to These Terms

We may update these Terms at any time. Your continued use of the website means you accept the updated Terms.

13. Governing Law

These Terms are governed by the laws of the Democratic Socialist Republic of Sri Lanka.
